Why Use This Route for Recruitment?

Benefits for German Companies

Faster & Easier Hiring

Through this regulation, companies can gain pre-approval (Vorabzustimmung) from the Federal Employment Agency before a visa application.

Larger Pool of Workers

You can recruit from six Balkan countries, accessing both qualified and less formally qualified workers.

No Qualification Requirement

For non-regulated professions, there is no obligation to verify formal credentials.

Annual Quota

Up to 50,000 approvals (Zustimmungen) per year across these countries, as of June 2024.

Equal Working Conditions

The working conditions (salary, contract) offered must be equivalent to what comparable German workers would get.

Requirements & Conditions

Here, clearly list what the employer and the worker need to satisfy under this regulation.

Employer Requirements
Concrete Job Offer

You must provide a signed employment contract or at least a binding job offer.

Equal Working Conditions

The working conditions must be equivalent to those offered to comparable German workers.

Sufficient Salary

The salary must be high enough to cover the employeeโ€™s living costs in Germany (visa-relevant).

Employee / Worker Requirements
Eligible Citizenship

Must be a citizen of one of the six West Balkan countries.

No Asylum Benefits

Must not have received benefits under the German Asylum Seekersโ€™ Benefits Act in the past 24 months

Additional Rule for Age 45+

If the worker is older than 45 and it's their first application via West Balkan Regulation, they must either: Earn a gross annual salary of at least 55% of the statutory pension insurance contribution ceiling (for 2025: 53,130 โ‚ฌ) or Provide proof of adequate pension provision.

Other Conditions:
  • The West Balkan Regulation does not apply to residence permit renewals.
In such cases, the Foreignersโ€™ Office (Auslรคnderbehรถrde) is responsible.
  • Regulated professions are excluded. These professions require a separate procedure, such as formal qualification recognition.

Application / Process: How It Works (with Your Company)

Simplified process to recruit through the West Balkan Regulation.

Step 1: Needs Assessment

  • You talk to the employer and understand exactly what kind of workers they need (role, experience, contract type, salary, working hours).
  • You help define the job description in a way that will work for visa and labor market approval.

Step 2: Candidate Sourcing & Screening

  • You tap into your network (in the West Balkan region) to find potential candidates.
  • Pre-screen them (CV, interviews, reference) to ensure they fit the job.

Step 3: Preparation of Documents

  • Prepare all needed documentation for the Vorabzustimmung (pre-approval) to the Bundesagentur fรผr Arbeit: job offer, employment contract, proof of salary, etc.
  • Help the candidate obtain any required documents (passport, CV, proof of background) from their home country.

Step 4: Application for Pre-Approval (Zustimmung)

  • You or the employer apply to the Federal Employment Agency (ZAV or relevant office) for the Vorabzustimmung.
  • Once approved, the candidate can apply for the visa at the German embassy / consulate in their home country.

Step 5: Visa & Entry

  • Candidate applies for a national (work) visa, with your support and the pre-approval.
  • After visa issuance, they come to Germany and start working under the conditions agreed.

Step 6: Integration & Follow-up:

  • Optionally, you could provide support for relocation (finding accommodation, getting health insurance, opening a bank account).
  • Support for onboarding, cultural integration, and continuous employment monitoring.

Risks & Challenges / Things to Watch For

Important considerations to make the process realistic and demonstrate expertise.

Quota Risk

Because the West Balkan rule is quota-based (50,000 per year), there may be delays or โ€œmonthly quotasโ€ for certain nationalities.

Administrative Delays

Even with pre-approval, visa appointment scheduling (at embassies) might take time, depending on the country.

Regulated Professions

For professions like medicine, you need formal recognition of qualification โ€” this route doesnโ€™t simplify that.

Wage Risk / Compliance

You must ensure that pay and working conditions are at least equal to comparable German workers, to pass the approval.

Benefit History Check

If a candidate has recently received social benefits (in Germany), they might be disqualified.
